Insolvency and Corporate Restructuring

Our insolvency and corporate restructuring practice group has extensive experience and expertise in receiverships, proposals, bankruptcies, foreclosures, mortgage remedies, corporate workouts and reorganizations, collections and insolvency matters generally. Our insolvency lawyers have assisted both debtors and creditors and can deal effectively with large and small corporate reorganizations and restructurings under various statutes, including the Companies’ Creditors Arrangement Act (Canada) (the “CCAA”) and the Bankruptcy and Insolvency Act (Canada) (the “BIA”). Our insolvency lawyers are able to assist an insolvent, or potentially insolvent, individual or corporation to develop an effective strategy to either avoid, or initiate, bankruptcy proceedings with optimum outcomes. Creditors dealing with insolvent, or potentially insolvent, debtors will benefit from our understanding of the various applicable regimes to maximize recovery and minimize exposure and risk. Our expertise extends to determining and evaluating the priorities of different secured creditors, the Crown and others in insolvency situations.
